We aim to represent the welfare of all residents on Hayes Country Park. We will seek to liaise with the Site Management and discuss residents' concerns. We will look to inform residents of their rights and keep everyone updated with National News issues that affect all park home owners. We will also endeavour to keep residents informed of local news and events.
Yes, of course you can. If you wish to benefit from the activities of the association, we will accept members from any other group or organisation.
The forum can inform you of your rights but it has no powers or legal recognition. A qualifying Residents Association is a legally recognised, independent body with rights.
Because if you decide in the future that a qualifying Association is needed it would take a long time to set one up. For example, it has taken nearly three months to set up a bona fide Treasurer's bank account. A delay in setting up a qualifying Residents Association could delay any support that they are able to offer residents. The Forum is reliant on the goodwill of the Site Owner and past experience has shown that that support can be withdrawn at any time. A qualifying Association would not be at risk in the same circumstances as it is an independent and legally recognised organisation.
The residents association will not get involved in emergency repairs around the site. We will not need to see and/or approve any quotations or specifications for emergency repairs. However, once we achieve qualified status the site owner will be obliged to share the detailed costs of any improvements or additional works around the site - especially where the owner intends to seek reimbursement from the residents in a pitch fee review.
We have been assured by Michelle that anyone can approach the office with any problems and she will endeavour to get all issues resolved as soon as possible. The association will only get involved if we are asked to do so by a member or if the issue is a weighty matter that affects other residents. Therefore, it will do no harm to inform the Association of your concerns.
We cannot 'represent' individual residents, but can provide support. We would suggest that you initially discuss any individual problems with the site management before asking for support from the Association. However, there will be times when what you think is an individual problem actually also affects other residents. So, it won't hurt to let the Association know of your concerns.
To allay any concerns that you have, we can guarantee that all members names and contact details will be kept private in line with the Data Protection Act. Once we reach the membership target and achieve qualified status, we will have protection from harassment under the law. By reporting any incidents and the actual management response to the Council, The Residential Property Tribunal and the Police, we would be listened to.
The membership fees for 2023 are £15 per property (not per person). This includes £5 per property for group membership of IPHAS. If you are already a member of IPHAS or do not wish to join, the membership fee is £10 per property. The fees are to cover administration costs only and will be reviewed by the elected committee on a regular basis. Aside from administration costs (such as printing inks, paper, hall hire costs and website fees) the committee is not entitled to spend money without securing a vote from the members.
The membership fees for the Association are to pay for administration costs - such as the website, printing, paper, inks etc. for circulars, application forms and hall hire costs for meetings. We do not know how the forum can operate without being subsidised.
No, but we are hoping that they will appreciate that the Association only wants what is best for Hayes Country Park - which is the same priority as the Site Owner and site management.
Legally, yes. We hope that the site management will recognise our Association. Once we reach qualifying status we can force the Site Owner to recognise us and allow the Association its due rights under the Mobile Homes Act 1983, via the Residential Property Tribunal.
Not unduly, we do not need to engage solicitors or barristers for a Residential Property Tribunal. There are standard forms to use for this type of application and the fee for a Tribunal hearing is minimal.
Yes. However without reaching qualifying status, the Site Owner can always claim that the Association does not represent the majority of park home owners on site.
